Through this Privacy Policy, the user is informed in a clear, precise, and concise manner. If the user accepts it, they will give their free, informed, specific, and unequivocal consent for MACROTEST to process their personal data, in accordance with EU Regulation 2016/679 on the protection of natural persons regarding the processing of their personal data and the free movement of such data (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD) (current European and national data protection legislation).

Submitting job applications: Work with us
On our website, users can submit their CVs if interested in joining the MACROTEST team. This data will not be shared with third parties without the candidate's consent.

2.2.3. What is the purpose of processing the user's personal data?

MACROTEST processes personal data for the following purposes, depending on the reason for its provision:

  1. Providing contracted products/services, maintaining the contractual relationship, and its follow-up.
  2. Contacting, processing, managing, and responding to the user's requests, inquiries, or issues (via email, contact form, or phone).
  3. Managing the client's purchase process and addressing any related queries.
  4. Managing the sending of information about MACROTEST's products, services, and updates through electronic or conventional means.
  5. Evaluating and managing CVs submitted by users for selection processes suited to their professional profile and carrying out necessary hiring activities.

2.2.4. What is the legal basis for processing the user's data?

  • The legal basis for processing personal data for the aforementioned purposes is the execution of the relevant service provision, as mandated by Article 6.1(b) of GDPR.
  • For sending information about products, services, and updates associated with MACROTEST, the legal basis is the express consent provided by the user, in accordance with Article 6.1(a) of GDPR.
  • For processing data related to CVs and other personal/professional data submitted to MACROTEST, the legal basis is the express consent provided by the user, as per Article 6.1(a) of GDPR.

2.2.5. How long will the user's personal data be processed?

  • Data for managing the client relationship, invoicing, and payment for services will be retained for as long as the contract is active. Once the relationship ends, data may be retained for the time required by applicable legislation and until the statute of limitations expires for any contractual liabilities.
  • Data for managing queries and requests will be retained as long as necessary to respond, or until the user requests withdrawal of their consent.
  • Data for sending information about MACROTEST's products or services will be retained until the user withdraws consent.
  • CV data submitted by candidates for selection processes will be retained for a maximum of two years.

2.2.6. To which recipients will the user's personal data be communicated?

As a general rule, your data will not be transferred to third parties unless there is a legal obligation or it is necessary to provide the service. Considering this:

  • The user's personal data could be communicated to the financial institutions through which payment management is carried out.
  • Only in legally necessary cases, the data will be communicated to the State Security Forces and Corps.
  • They could also be communicated to the competent Public Administrations in the cases provided by law.
  • If applicable, the data will also be communicated to the Data Processors of MACROTEST for the correct provision of the service.

2.2.7. What are the user's rights?

Data protection regulations allow you to exercise your rights of access, rectification, erasure, and portability of data, as well as opposition and limitation to processing, and not to be subject to decisions based solely on the automated processing of your data, when applicable.

These rights are characterized by the following conditions:

  • Exercising these rights is free of charge unless the requests are manifestly unfounded or excessive (e.g., repetitive), in which case MACROTEST may charge a fee proportional to the administrative costs incurred or refuse to act.
  • You may exercise the rights directly or through your legal or voluntary representative.
  • We must respond to your request within one month, although, considering the complexity and number of requests, the period can be extended by another two months.
  • We are obliged to inform you about the means to exercise these rights, which must be accessible and we cannot deny the exercise of the right solely because you choose another method. If the request is submitted electronically, information will be provided through these means when possible, unless you request otherwise.
  • If MACROTEST does not act on the request, we will inform you, at the latest within one month, of the reasons for not acting and the possibility of filing a complaint with a Supervisory Authority.

In both cases, you must verify your identity by attaching a photocopy or, if applicable, a scanned copy of your ID card or equivalent document to ensure that we respond only to the data subject or their legal representative, who must provide a document proving their representation.

Furthermore, if you feel that your rights have not been fully satisfied, we inform you that you may file a complaint with the national supervisory authority by contacting the Spanish Data Protection Agency (AEPD), C/ Jorge Juan, 6 – 28001 Madrid (www.aepd.es).

2.2.8. What security measures have we implemented?

At MACROTEST, we are committed to protecting your personal information.

We use reasonably reliable and effective physical, organizational, and technological measures, controls, and procedures aimed at preserving the integrity and security of your data and ensuring your privacy.

In addition, all personnel with access to personal data has been trained and is aware of their obligations regarding the processing of personal data.

In the case of contracts with our suppliers, we include clauses that require them to maintain the duty of confidentiality regarding personal data to which they have had access due to the commissioned work, as well as to implement the necessary technical and organizational security measures to guarantee the confidentiality, integrity, availability, and permanent resilience of the personal data processing systems and services.

All these security measures are periodically reviewed to ensure their adequacy and effectiveness.

However, absolute security cannot be guaranteed, and no security system is completely impenetrable. Therefore, if any information under our control is compromised due to a security breach, we will take appropriate measures to investigate the incident, notify the Supervisory Authority, and, where appropriate, affected users so they can take appropriate action.

MACROTEST has a corporate profile on the social media platforms Instagram, Facebook, and LinkedIn.

Therefore, MACROTEST is the "Data Controller" of your data due to the existence of these profiles on social media and the fact that the user follows us, allowing us to follow them back.

This means that if the user decides to join our corporate profile as a follower, or by giving a "Like" or "Thumbs Up" to our content or profile, they accept this policy, where we explain their rights and how we use their data.

As the data controller, we guarantee confidentiality in the processing and compliance with the user's rights, always under the effects of the current data protection regulations.

Furthermore, we inform you that we will use these social media platforms to announce news or relevant information related to the services we offer, or topics that we consider may be of interest to the user. Using the features of these platforms, it is possible that the user will receive news of this type of information on their wall or profile.

However, we also inform you that there is no link between MACROTEST and these platforms or social networks, so the user accepts their usage policies and conditions once they access them and/or validate their notices and terms and conditions during the registration process. MACROTEST is not responsible for the use or processing of user data outside of the strict relationship and service provision outlined in this policy.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

We warn you that MACROTEST holds all intellectual and industrial property rights to the website and all its elements (for example: images, sound, audio, video, software or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs required for its operation, access, and use, etc.).
